Divorce in Massachusetts can be a complex process. Contested divorces will be emotionally and financially draining. The client should keep in mind that in “amicable”, uncontested divorces there are many more issues to be resolved than just “We both want a divorce”. These issues include, but are not limited to:
Child Custody Arrangements and Support
Parenting Plans
Educational Expenses
Spousal Support
Division of Assets and Liabilities
John and Ann will work with you to make sure you are informed and involved in the decision-making needed to resolve the contested issues in your divorce. John and Ann can assist you whether your case is a hotly contested, complex battle or an amicable divorce where you "just need some papers drawn up." They will work to ensure that you are treated fairly in either type or any in-between.
When two unmarried people have children together, then decide to part ways, there are many issues relating to the children, similar to those in a divorce, that must be resolved. These can be resolved through a negotiated agreement of the parties that becomes a judgment, or a contested matter. Our office will make sure that you are treated fairly, are kept informed, and are involved in decision making whether contested or negotiated.
When the parents of children are not married, many of the same issues need to be addressed. Any action taken by the court will address the following:
Child Custody Arrangements and Support
Parenting Plans
Educational Expenses
In addition to mediation, Attorney Ann Rascati assists the Court as a Guardian ad Litem and assists families as a Parenting Coordinator. Guardians’ ad Litem gather facts and report them to the Court as if putting a puzzle together for the Judge to see. If asked, they might also offer recommendations as what the Court should decide.
A Parenting Coordinator assists parents pursuant to a Court Order or Judgment to become effective co-parents. The goal is to work together for the best interests of the children. Parenting Coordinators will help co-parents mediate disputes and hopefully reach an agreement. When they cannot do so, the Parenting Coordinator may make a binding decision if authorized by the Court, with the full force and effect of the Court behind it or make recommendations that do not carry the weight of the Court.
John and Ann have developed a close network of other lawyers and professionals who can help in those specialized areas where they do not practice.
